In beer OEM cooperation, the contract is not a mere formality, but the underlying basis for quality control, delivery schedules, and legal accountability. Deviations in beer flavor, products being ordered off the market by regulatory authorities due to label issues, mixed filling batches, and packaging color differences exceeding national standard limits are not isolated incidents; they often result from ambiguous or missing contract clauses. The following eight categories of clauses must be clearly agreed upon one by one, without exception.
Subjective descriptions such as “full-bodied taste” and “pronounced malt aroma” have no enforceable effect. The contract must specify concrete parameters: the permissible deviation for original wort gravity (°P) is ±0.3°P; the deviation between the measured and nominal alcohol content must not exceed ±0.2%vol; the error range for bitterness (IBU) must be limited to within ±5 units; turbidity (NTU) must specify the testing method, such as ISO 7506, and the sampling location, such as after 48 hours of filling under static, light-protected conditions at room temperature. Where functional ingredients such as hyaluronic acid or oyster peptides are involved, the testing method, such as HPLC, detection limit, and third-party retesting mechanism must be agreed upon.
For the same glass bottle, a wall-thickness tolerance exceeding 0.15mm can affect the uniformity of heat transfer during pasteurization; if the adhesion of the internal coating of an aluminum bottle fails to meet GB/T 1732, metal ions may leach into the beer. The contract must list the packaging material suppliers, specifically the entities registered under SC numbers rather than brand names, key physical parameters such as a can-body yield strength of ≥210MPa, migration levels of printing inks complying with the GB 9685 standard for food-contact materials, and cap torque values such as 2.2±0.3N·m. For non-standard containers such as PET kegs, the pressure value and pressure-holding duration for pressure-resistance testing must be agreed upon separately.
Whether “edible flavoring” in the ingredient list must be identified by its specific name, whether the “low-alcohol” claim meets the mandatory threshold under GB 2758 of an alcohol content of ≤0.5%vol, and whether the country of origin must be indicated for imported raw materials are all matters for which the party responsible for label review bears primary responsibility. The contract must specify which party submits the final label version to the local market regulatory authority for preliminary review; any penalties resulting from label wording, font size, or missing warning statements shall be fully borne by the responsible party; and the method for verifying consistency between sample labels and labels used for mass production, such as randomly comparing three bottles from each batch.
Flavor variation between batches of craft beer is normal, but it must be controlled within acceptable thresholds. The contract should stipulate that when the same formulation is produced continuously for no more than five batches, the relative standard deviation (RSD) of gas chromatography test values for key flavor compounds, such as isoamyl acetate and phenethyl alcohol, must not exceed 12%; if the customer provides a reference beer sample, the mass-production beer sample must be determined to have no significant difference through the Triangle Test (p<0.05). If the limits are exceeded, the supplier must rebrew the beer at no charge and bear the resulting storage and demurrage costs.
Excessive yeast autolysis products may cause diacetyl levels to rise, while a settled colony count of >10CFU/plate in the filling environment increases the risk of microbial contamination. The contract must specify the cleanliness class of the filling room (ISO 8), CIP cleaning parameters for pipelines before filling, including an alkaline cleaning temperature of ≥85℃ and duration of ≥20 minutes, the upper limit for the total colony count in finished beer (≤50CFU/mL), and the requirement that coliform bacteria must not be detected, in accordance with GB 4789.3. The testing frequency must cover the first, middle, and final samples of each shift.
A minimum order of one keg does not mean that orders may be divided arbitrarily. The contract must specify the minimum volume for a single order, such as 1,200L, and that this volume must correspond to the capacity of a complete fermentation tank, thereby avoiding abnormal yeast activity caused by half-tank fermentation. If the customer requests an interim specification change, such as changing a 500mL bottle to a 330mL can, a written request must be submitted 72 hours in advance, and the customer shall bear the scrapping loss of packaging materials already purchased. If the order is canceled for reasons attributable to the customer, beer that has already entered production shall be settled at cost, while a 15% design reservation fee shall be charged for the portion not yet put into production.
Sensory disputes typically emerge within 3–7 days after delivery. The contract must stipulate that the supplier retain three parallel 500mL samples for each batch, stored at a constant temperature of 12℃ and protected from light. Any quality objection raised by the customer must be submitted in writing within five working days after receipt of the goods and accompanied by a report from a third-party testing institution. Failure to raise an objection within the prescribed period shall be deemed acceptance. If the objection is substantiated, the supplier must provide retained samples from the same batch for retesting within 48 hours. If the retest also fails, the replacement or refund process shall be initiated.
Formulation drawings, proprietary yeast strains, customized fermentation curves, and other materials provided by the customer constitute trade secrets. The contract must stipulate that the supplier may not use the customer's beer formulation or process for producing products for other brands; may not retain the customer's proprietary freeze-dried yeast powder for more than 30 days after the production cycle; where the supplier participates in designing a packaging structure patent, its copyrights shall belong to the customer, while the supplier retains the general right to use basic structural modules; and all technical documents exchanged shall be transmitted in encrypted form, with video records provided for the destruction of paper documents.
The vitality of contract clauses lies in their verifiability, traceability, and accountability. When every technical parameter corresponds to a testing method and every boundary of responsibility is supported by an operational procedure, beer OEM can truly evolve from a contract-manufacturing relationship into joint quality development. Without relying on verbal promises, a technical agreement set out in black and white is the firmest foundation for a stable supply chain.
