Default legal rule: the party that conducts the research and development owns the original intellectual property. In ODM arrangements, the beer formula and brewing process are developed by the brewery, which is the commissioned R&D party. Unless otherwise agreed in a written contract, the intellectual property rights to the formula naturally belong to the brewery, while the brand owner only has the right to sell the finished products and owns the trademark rights to its own brand.
